Welcome to WhitAI.app, a service owned and operated by School Synergy, S-Corporation ("School Synergy," "we," "our," or "us"). These Terms of Use govern your access to and use of our educational technology platform. By accessing or using our services, you agree to be bound by the following Terms of Use and Agreement ("Terms"). If you do not agree with these Terms, please do not use the platform.

1. Acceptance of Terms

By creating an account, accessing, or using any part of WhitAI.app, you agree to be legally bound by these Terms. This agreement applies to all users of the site, including but not limited to teachers, students, administrators, and other contributors.

2. Eligibility

• Users under 18 must have parental or guardian permission to use the platform.
• Schools or districts must ensure they comply with FERPA, COPPA, and other applicable student data privacy laws before allowing student access.

3. User Responsibilities

Users agree to:

• Use the platform for lawful educational purposes only.
• Not submit, upload, or distribute content that is defamatory, obscene, harassing, harmful, or otherwise inappropriate.
• Maintain the confidentiality of login credentials.
• Be responsible for all activity under their account.

4. Data Collection and Privacy

WhitAI.app may collect limited user data to enhance functionality. We do not sell user data. All data practices are governed by our Privacy Policy. By using the platform, you consent to our data handling practices.

For students: Only minimal data (e.g., first name, school email, and assignment submissions) may be collected, and only for educational purposes.

5. AI-Generated Content

WhitAI.app uses AI models to provide feedback, generate learning materials, and support instruction. While we strive for accuracy and educational relevance:

• No AI-generated content is guaranteed to be error-free.
• Teachers remain responsible for reviewing and validating any AI-generated feedback or materials.
• WhitAI.app is not liable for educational outcomes, grading errors, or instructional decisions based on AI output.

6. No Guarantee of Availability or Accuracy

We make no guarantees that the platform will be error-free, uninterrupted, or that the information provided will meet all educational standards or curriculum requirements.

7. Limitation of Liability

To the fullest extent permitted by law:

• WhitAI.app and its creators, partners, and affiliates shall not be liable for any direct, indirect, incidental, or consequential damages, including but not limited to educational disruptions, data loss, or errors in content.
• The platform is provided "as is" and "as available" without any warranties, express or implied.

8. Intellectual Property

All original content, software, and branding on WhitAI.app are the property of the platform owner. You may not copy, reproduce, or distribute content without permission, except as permitted under fair use for educational purposes.

9. Modifications to the Service or Terms

We reserve the right to update or modify the platform or these Terms at any time without prior notice. Continued use of the service constitutes acceptance of those changes. We encourage users to review the Terms regularly.

10. Termination

We reserve the right to suspend or terminate access to any user who violates these Terms or misuses the platform in any way. Termination may occur without prior notice.

11. Jurisdiction and Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any legal disputes must be filed in the appropriate court in that jurisdiction.
